What Is VAWA: Everything You Must Know About Your Rights

Victims of domestic violence and battery can seek immigration protections and independently petition for a green card under the Violence Against Women Act (VAWA) administered by U.S. Citizenship and Immigration Services (USCIS). Despite its name, this federal law applies to all individuals regardless of sex, gender identity or sexual orientation.

In addition to physical violence, VAWA immigration coverage includes nonphysical abuse. This can include extreme emotional, financial or coercive control, which you can use as evidence to meet the statutory standard of extreme cruelty.

How You Can Apply Independently For A Green Card Under VAWA

While VAWA allows you to file for a green card independently, you may only qualify if you meet the law’s eligibility criteria:

  • Abused spouse: You must show that you married in good faith and that your U.S. citizen or LPR spouse abused you or your child.
  • Abused child: Eligible victims must be unmarried and under 21, though individuals up to age 25 may apply if the abuse directly delayed their filing.
  • Abused parent: The abusive child must be a U.S. citizen and at least 21 years of age.
