Adjustment Of Status Lawyer

Adjustment of status is an important step for foreign nationals who are already in the United States and want to apply for a green card without leaving the country. The process allows eligible applicants to seek lawful permanent residence from inside the U.S., but the rules can be detailed. Working with an immigration attorney can help applicants understand whether they qualify before filing.

Zambrano Law helps individuals and families review their adjustment of status options and prepare for the green card process. Because immigration status, entry history, family relationships, employment sponsorship and past immigration issues can all affect eligibility, we can help applicants avoid mistakes that may delay or harm their case.

Who May Qualify For Adjustment Of Status?

Adjustment of status is available to certain foreign nationals. Many applicants qualify through a family-based petition, employment-based petition, asylum or refugee status, or another eligible immigration category.

Basic eligibility may include:

  • Being physically present in the United States
  • Having a valid basis to apply for a green card
  • Having an immigrant visa available, unless an exception applies
  • Being admissible to the United States
  • Filing the correct forms and supporting evidence
  • Not being barred by certain immigration violations or criminal history

Eligibility is not the same for every applicant. Some people may need a waiver, additional documentation or a closer review of past entries, overstays, unauthorized work or prior immigration filings. We can help you understand how the rules apply to your specific situation.

How The Adjustment Of Status Process Works

The adjustment of status process begins with confirming your green card category and whether a visa is available. In many cases, you must file an immigrant petition, such as a family-based or employment-based petition, either before or at the same time as the adjustment application. Then, you submit:

  • Form I-485
  • Application to Register Permanent Residence
  • Adjustment of status, along with required documents, fees, photographs and proof of eligibility

USCIS may then schedule a biometrics appointment, request more evidence or require an interview. If approved, you become a lawful permanent resident.
