U Visas For Crime Victims Seeking Immigration Protection

Last updated on June 16, 2026

Victims of serious crimes may have immigration options that allow them to seek protection while helping law enforcement investigate or prosecute criminal activity. A U visa is available to certain victims of qualifying crimes who have suffered substantial physical or mental abuse and who have been, are being or are likely to be helpful to law enforcement. It is important to work with an attorney who understands how these applications are reviewed.

Zambrano Law helps individuals and families in Georgia understand whether a U visa may be available and what steps are needed to move forward. We know these cases involve fear, trauma and uncertainty, and we work with our clients to prepare complete, well-supported applications.

Who May Qualify For A U Visa?

A person may qualify for a U visa if they were the victim of a qualifying criminal activity, suffered substantial abuse because of that crime and have information that may help law enforcement.

The applicant must also be helpful, have been helpful or be likely to help police, prosecutors, judges or other authorities handling the case. Common qualifying crimes include:

  • Domestic violence
  • Sexual assault
  • Human trafficking
  • Kidnapping
  • Felonious assault
  • Abusive sexual contact
  • Obstruction of justice
  • Witness tampering
  • Extortion
  • False imprisonment

This list is not the full scope of qualifying crimes. We can review what happened, explain whether the crime may fit within U visa requirements and help determine what evidence may support the application.

Can Family Members Be Included?

Some family members may also be eligible for immigration protection through the U visa process.

Depending on the applicant’s age and circumstances, this may include a spouse, children, parents or unmarried siblings under 18. Our lawyers help families understand who may qualify and how derivative applications should be prepared.

Why Timing And Preparation Matter

There is an annual cap on the number of U visas granted in the United States. Even when someone qualifies, the process can take time, making careful preparation especially important.

We assist with initial U visa applications, extensions for current U visa holders and green card options for those who become eligible after holding U status.
