Understanding T Visas
A T visa is a nonimmigrant visa that protects human trafficking survivors in the United States. The Trafficking Victims Protection Act of 2000 created this visa to give survivors a legal path to safety and support law enforcement. T visas may be available to:
- Trafficking survivors: Those physically present in the U.S. due to trafficking, regardless of immigration status
- Minor survivors: Applicants under 18 are exempt from the law enforcement cooperation requirement
- Eligible family members: Spouses, children and, in some cases, parents or siblings
A T visa provides up to four years of legal status and includes work authorization. Certain family members may receive protection and remain in the United States with you. After three years of continuous presence and compliance with law enforcement requests, you may apply for permanent residence or earlier if the trafficking investigation or prosecution is fully complete.
How The T Visa Application Process Works
Understanding the T visa process is key to avoiding delays and protecting your claim. A qualified attorney can help you prepare thoroughly and handle complications before they arise. A T visa application typically involves:
- Gathering evidence documenting the trafficking
- Writing a personal statement about your experience
- Obtaining a law enforcement endorsement if possible
- Filing Form I-914 with the U.S. Citizenship and Immigration Services
- Filing applications for eligible family members
- Responding to any requests for evidence
At Zambrano Law, we review every detail before we file your application. Our attorneys bring over 24 years of combined experience across a wide range of immigration matters. That depth means we know how to get your case filed right the first time.
