Helping You Understand How Removal Works

Removal proceedings can have several grounds. These may include overstaying the limits of a visa, ineligibility for a visa, committing a felony or missing a renewal deadline. There are many ways to be removed from the U.S. A few examples include:

  • Expedited removal: Occurs after an arrest at or near the U.S. border.
  • Reinstatement of removal: If you were previously deported or removed from the U.S. and you are caught during or after re-entry into the U.S.
  • Administrative removal proceedings: You can be put in these proceedings after committing an aggravated felony if you do not have lawful permanent residence.

If you have received a document titled “Notice to Appear,” then the government has initiated regular removal proceedings against you. Receiving an “Order to Show Cause” means that you are in deportation proceedings. Receiving a document numbered either Form I-110 or I-122 at the bottom means that you are in exclusion proceedings.

Cancellation Of Removal (Deportation)

Some immigrants facing deportation may qualify for cancellation of removal if they meet specific legal requirements. This allows them to stay in the U.S. despite a deportation order. There are two types:

  • Cancellation of Removal for Lawful Permanent Residents: For Immigrants with Lawful Permanent Residency status, to qualify, they must have been living in the United States for at least seven years. They also need to show that you are a person of good moral character. Additionally, they must prove that their removal from the country would create extremely difficult circumstances for their family members who are U.S. citizens or legal permanent residents.
  • Cancellation of Removal for Non Lawful Permanent Residents: For immigrants without legal status. You need ten years or more in the U.S., good moral character, and proof that deportation would cause exceptional hardship to a U.S. citizen or lawful permanent resident family member.
