USCIS Ends Automatic Work Permit Extensions: What You Need to Know and How to Protect Your Job

On Behalf of | Nov 4, 2025 | Firm News

Effective October 30, 2025, USCIS officially ended the automatic extensions for Employment Authorization Documents (EADs) — a change that will deeply impact thousands of immigrants, their employers, and the U.S. economy.

This new rule means that immigrants must now renew their EADs (work permits) well in advance — ideally at least 6 months before expiration — to avoid losing their right to work legally in the United States.

⚠️ What This Means for Immigrant Workers

Before this change, many applicants could continue working for up to 180 days after filing their EAD renewal, thanks to automatic extensions. That protection is now gone.

If your work permit expires and your renewal hasn’t been approved, you cannot legally work, even if your renewal was submitted on time. This gap can lead to job loss, financial hardship, and interruptions in vital benefits like health insurance or driver’s license renewals.

At Zambrano Law, we strongly urge all clients to check the expiration date on their EAD card and start the renewal process at least six (6) months before it expires.

💼 How This Change Affects Employers and the Economy

Employers who rely on immigrant talent are now facing new challenges. Without automatic extensions, businesses may experience workforce shortages, increased administrative costs, and disruptions to operations.

At a national level, this policy change could slow productivity and harm local economies that depend on immigrant workers in essential industries such as construction, hospitality, healthcare, and logistics.

Zambrano Law stands ready to assist both employers and employees in navigating this new landscape efficiently and lawfully.

⏳ If Your EAD Renewal Is Delayed — You Still Have Options

Processing times for work permits have become unpredictable, leaving many applicants in limbo. But you don’t have to wait in silence.

Our legal team can take proactive steps to push your case forward, including:

  • Mandamus Lawsuits: A federal legal action that compels USCIS to make a decision on long-delayed cases.
  • Congressional Liaison Inquiries: A formal request through your local congressional office to investigate delays and urge action.

We have successfully used these tools to help clients get their EADs approved faster — restoring their ability to work and support their families.
